Governing Laws: Republic Act No. 11967 (Internet Transactions Act), Republic Act No. 11900 (Vape Law), Republic Act No. 7394 (Consumer Act), and Republic Act No. 8792 (E-Commerce Act).

A. Acceptance of Terms & Legal Capacity 

By accessing this website and purchasing products, you affirm that you are at least eighteen (18) years of age and possess the legal capacity to enter into a binding contract. If you are under 18, please discontinue use immediately.

B. Mandatory Age Verification

  1. Hard Age-Gating: In compliance with DTI DAO 25-04, users must complete a one-time age verification process involving the submission of a valid government-issued photo ID.
  2. Delivery Verification: Products will only be released to the buyer or an authorized representative who is at least 18 years old. The courier is strictly mandated to verify physical ID upon arrival.
  3. False Declaration: Providing false information regarding age is a violation of RA 11900. We reserve the right to cancel orders and report fraudulent accounts to the relevant authorities.

C. Pricing, Payment, and Official Receipts

  1. Currency: All prices are in Philippine Pesos (PHP) and are inclusive of VAT.
  2. Transparency: Delivery fees and total costs are finalized at the checkout page before payment.
  3. Official Receipts: In compliance with BIR regulations, an Electronic Official Receipt (e-OR) or physical receipt will be issued for every transaction.

D. Order Fulfillment & Merchant Liability

  1. Finality: Orders are considered final once the status is “In Transit.” Cancellations are not permitted for dispatched items or perishable nicotine products (e.g., nicotine pouches).
  2. Merchant Responsibility: Under the ITA of 2023, Smokeless Philippines OPC bears the risk of loss or damage until the goods are delivered.
  3. Failed Delivery: If delivery fails due to incorrect customer data or absence of a 18+ recipient, the customer may be liable for re-delivery fees.

E. Returns, Exchanges, and Refunds

  1. Defective Goods: Per the Consumer Act, you have the right to a repair, replacement, or refund for defective items. Please notify us within seven (7) days of receipt.
  2. Exclusions: Returns for “change of mind” are not permitted for hygiene and safety reasons regarding nicotine products once the seal is broken.
  3. Verification: Returned items must be in original packaging with the BIR tax stamp and security seals intact for a refund to be processed.

F. Internal Redress Mechanism (Complaints) 

We are committed to fair dispute resolution:

  • Acknowledgement: Within 24–48 hours of receipt.
  • Resolution Window: We aim to resolve all valid complaints within seven (7) calendar days.
  • Escalation: If a resolution is not reached within 7 days, the customer may escalate the dispute to the DTI E-Commerce Bureau via www.dti.gov.ph.

G. Acceptable Use & Indemnity 

Users agree not to use this platform for illegal reselling or fraudulent activities. You agree to indemnify and hold Smokeless Philippines OPC harmless from any claims or penalties arising from your breach of these terms or the provision of false age credentials.
